Marshall man facing child pornography charges released on bail

A man facing charges that include sexual assault and distribution of child pornography was granted bail at a hearing in Lloydminster provincial court Monday.

Joseph Sproull, 40, of Marshall, is charged with one count of possession of child pornography, one count of distribution of child pornography, three counts of sexual assault, three counts of sexual interference, and three counts of making available child pornography.

Court documents indicate the alleged offence occurred between Aug. 26, 2020 and March 12, 2021.

A court ordered publication ban is in place on the details of the proceedings in the show cause hearing.

As part of the conditions of his release, Sproull must abide by a number of rules.

There is a publication ban on disclosing his place of residence as part of his release conditions.

Sproull must report to a probation officer; stay inside his approved residence daily from 9 p.m. to 6 a.m., unless he has a prior written approval from his probation officer, a designate or the court to be elsewhere.

He must have no contact directly or indirectly with any person under the age of 16, unless he is in the company of an adult approved by the probation officer. He must not go to any public park, or public swimming area where persons under age 16 may be, or to a school ground, playground, daycare centre or community centre.

He must also not obtain or continue any employment or volunteer in a capacity that involves being in the position of trust or authority towards persons under the age of 16.

Sproull must not access pornography; or use a computer to communicate with a person who is or he believes is under the age of 16.

He is prohibited from owning, possessing, accessing or using a computer, portable wireless communication device, smart phone, cellphone, or similar device that is capable of accessing the internet, except as required for employment, education or other purposes, after first obtaining written permission from his probation officer, regarding the place and circumstances.

He must submit to a search without warrant by any police officer who has grounds to believe he is breaching a condition, regarding any computer device use, access or possession related to the order.

Sproull is due back in Lloydminster court at 10 a.m. on Oct. 18.

According to the initial RCMP report, police executed a search warrant on July 14, 2021 at a residence on First Ave. E. in Marshall, Sask., where a home-based daycare was operating. As a result of an ongoing investigation, Sproull was arrested and charged. Police said Sproull was residing in the house where the home-based daycare was running.

The Ministry of Education suspended the daycare licence on July 16, 2021, and advised all parents of the change.

North Battleford RCMP General Investigation Section (GIS) has taken carriage of the sexual assault investigation with the assistance of Saskatchewan ICE, Maidstone RCMP, RCMP National Victim Identification Unit, North Battleford RCMP Forensic Identification Unit and the Midwest Victim Services Program.

The allegations against the accused have not been proven in court.
