Abraham Eagle sentenced to life in prison for second-degree murder

A Saskatoon judge found Abraham Eagle, 24, guilty of second-degree murder in the stabbing deathof Kelly Brian Diehl in 2013.

The 29 year old was stabbed three times and died in an alley behind his Fourth Avenue North apartment building in the City Park neighbourhood on Aug. 29, 2013.

A second-degree murder charge carries a minimum life sentence.

For nearly two weeks, a judge heard evidence presented at the trial. 

Eagle’s brother, Albert, is also charged with accessory after the fact to murder. His trial was supposed to start this week, but was delayed after he fired his lawyer.

The Crown argued that Eagle took a knife from a friend’s apartment and used it to attack Diehl but the only DNA found at the crime scene came from his brother.

During closing arguments, the defence suggested it could have been Albert who stabbed Diehl.

The motive for the murder isn’t known but witnesses say Eagle had been drinking heavily the day Diehl was killed.

The judge ruled that there was no direct evidence that Eagle meant to cause Diehl’s death but Eagle meant to cause bodily harm, likely to cause death.

The defense argued Eagle may have also acted in self-defence after being provoked by Diehl but the judge ruled he was not.
