OHS charges laid in connection to death of Prince Albert man

Two companies and an individual have been charged with violations of the Occupational Health and Safety Act and Regulations arising from an incident that resulted in the death of a Prince Albert man and his coworker in June of 2017.

Jared Moffat, 34, of Prince Albert and Tim McLean, 31, of Nipigon, Ontario died while working on the construction of a transmission line in the community of Come By Chance, N.L. The two were in the process of erecting a transmission tower when it collapsed prompting an investigating by OHS. The men were employed by Forbes Bros. Ltd., an Alberta-based power line construction company with offices across the country, including one in Prince Albert.

In a release issued on Friday, the government said the employer, Forbes Bros. Ltd., has been charged with seven OHS violations which relate to its alleged failure to:

– Ensure the health and safety of its workers;

– Provide the necessary information, instruction, training and supervision to its workers;

– Ensure its workers and supervisors were made aware of the hazards;

– Protect those not in their employ

– Include written work procedures appropriate to the hazards in its OHS Program

– Ensure work procedures promoted the safe interaction of workers and their work environment

– Ensure written rescue procedures were implemented.

Newfoundland and Labrador Hydro, the principal contractor, was charged with one count that alleges it failed to ensure that an employer and workers comply with the OHS Act and Regulations.

A Forbes Bros. Ltd. supervisor was charged with one count that alleges he failed to ensure the health, safety and welfare of all workers under his supervision.

The first court appearance in the matter is scheduled for July 4, 2019 at Provincial Court in Clarenville, NL.
