Judge allows most evidence against Prince Albert grandfather with child porn charges

A Prince Albert grandfather accused of having multiple sexual images of very young children, including his own granddaughter, has had most of the evidence against him allowed by a provincial court judge.

He had asked to have the evidence quashed, alleging his Charter rights were violated when police searched the home he was in and examined all of the devices in the residence.

Prince Albert Provincial Court Judge Shiefner, did not agree and ruled on July 15 that, with the exception of some Facebook messages, the search and evidence would be admittable at trial.

The man, who cannot be named to protect the identity of his granddaughter, came to police attention in March 2023 after the social media company, Reddit reported an issue to the National Center for Missing and Exploited Children.

An account with the username ‘PapaEagle58’ had uploaded a single image of suspected child pornography.

Reddit provided the email address, username and IP address of the user that uploaded the image and also shared that the internet provider was Shaw Communications, and the IP address was in Prince Albert.

The Saskatchewan Internet Child Exploitation Unit, which includes a Prince Albert Police officer, began their investigation by starting with the registered subscriber for the Shaw account.

It belonged to the accused man’s daughter.

A warrant allowed the investigator to search the woman’s home for devices capable of storing computer data.

During the search, the woman’s immediate family was found inside as was the accused. He was standing in a shower with his clothes on when police found him.

A preliminary check of the devices in the home showed an iPhone that was connected to the accused and had sexual images of the three-year-old granddaughter.

It had a Reddit account with the username PapaEagle58 and the email address shared by Reddit.

The forensic technician who examined the phone found 49 images and five videos of suspected child pornography. The oldest was in Edmonton in late 2022 while the most recent was in Prince Albert on April 15, 2023.

The daughter and mother of the toddler agreed to share the Facebook messages between her and her dad with police.

Schiefner ruled that B.C. had an expectation of privacy when he sent the messages to his daughter – including on her phone – but none when she replied.

The daughter is also free to testify about the content of all the messages during the trial.

His next court appearance is in Prince Albert Provincial Court on August 6.
