‘It’s a difficult decision I have to make’: trial uncertain for Prince Albert delivery driver accused of murder

Describing the circumstances of the case as a truly unique situation, a Prince Albert judge has reserved decision on whether to commit a man charged with second degree murder, to trial.

Rajdeepsinh Bihola’s preliminary inquiry hearing wrapped up on Tuesday afternoon at Prince Albert Provincial Court with submissions from the Crown and defence. The evidentiary portion wrapped up earlier month and lasted a total of three days.

A publication ban prohibits the publication or broadcast of all the evidence heard.

Bihola is facing a charge of second-degree murder in the death of 31- year-old Allan Andres in May, 2022.

Andres was struck and killed by a vehicle in the Cornerstone Parking lot and passed away in hospital the following week. Andres and his wife managed the Arby’s restaurant, and was working at the time of the incident.

While the exact details of the incident cannot be published, police have previously confirmed some sort of altercation took place between the victim and the accused.

Friends and family of Bihola have also previously explained to paNOW he had come to Canada about four years ago and was working as a driver for Skip the Dishes but was not working at the time of the incident.

The family members also stated Bihola did not know the victim, and wanted to make it clear this was an accident and not a hate crime.

Judge Steve Schiefner will render his decision on Jan. 5.

“It’s a difficult decision I have to make,” he said.
