Appeal court dismisses drug dealer attempt to overturn conviction

The conviction of Michael William Taylor for having enough methamphetamine in his possession for trafficking will stand.

Taylor, who is from Arborfield, appealed his sentence saying he had fresh evidence but the higher court did not allow him to adduce the new evidence or vacate his conviction, with all three judges in agreement.

Following his arrest in 2018 during which Taylor was caught inside the Co-op Gas Bar on Marquis Road police also arrested Brogan Sanderson, who was driving the vehicle Taylor exited.

Inside the vehicle that Sanderson was waiting in, officers found 205 grams of meth, a scale, bear spray, several cellphones and some cash.

Taylor was later convicted of possession for the purpose of trafficking but acquitted on charges of having a weapon and possession of the proceeds of crime.

The new evidence was an affidavit from Sanderson saying she was forced by the Crown prosecutor to testify against Taylor in exchange for 18 months of probation for her related charges.

The appeal court judges did not buy this; saying that Sanderson’s charges were resolved before Taylor’s and that if her testimony was a lie, that point would have been raised during his trial.

The appeal decision also listed various other considerations but Taylor, who was representing himself, failed to convince any of the judges the judgment was wrong.

Because Taylor’s appeal was not successful, his sentence of 36 months minus time served in remand remain in place.
