New sentence date for Wahpeton Dakota Nation drunk driver

Sentencing has been set for a Wahpeton Dakota Nation woman who killed a man with her car and her lawyer expects a stay of proceedings on some of the original charges, including a second degree murder charge.

Valerie Standing, from Wahpeton Dakota Nation, appeared at Prince Albert’s Court of Queen’s Bench today, June 13.

Outside of court, Standing’s lawyer Peter Abrametz said she faces charges of second degree murder, criminal negligence causing death and dangerous operation of a motor vehicle. Last March, Standing pleaded guilty to impaired operation of a motor vehicle causing death.

The charges stemmed from an April 10, 2013 incident where Standing hit Brant Fox with her car on Wahpeton Dakota Nation. Fox was pronounced dead at the scene.

Abrametz said Standing’s remaining charges will be stayed by the Crown after sentencing.

“In order to be guilty of murder, a person has to deliberately (intend) to commit death, but if someone is guilty of impaired driving causing death than the intent isn’t there. At the end of the day, this resolution is entirely appropriate,” Abrametz said.

He said Standing is relieved she won’t face three additional charges, and says she regrets what happened every single day.

Standing will be sentenced Sept. 23 at Prince Albert’s Court of Queen’s Bench.
