Trailer court murder case committed for trial

A woman accused of killing a man last summer at the East View Trailer Court, will be tried by a jury at Prince Albert Court of Queen’s Bench.

Lucinda Smith, 47, is facing a charge of second degree murder in the death of Dennis Hyman. On July 28, 2019, Hyman, was found unresponsive in one of the residences at the trailer court. He was declared deceased when police arrived.

A preliminary hearing, which spanned over three days this month, wrapped up Friday at provincial court. The judge concluded there was sufficient evidence to proceed to trial.

At the time of Smith’s initial arrest, she was charged with manslaughter but the charge has since been upgraded. The reasons for the decision are protected under a publication ban.

According to the Criminal Code of Canada, first or second degree murder charges cannot be tried by a provincial court judge, and so are presumptively tried by judge and jury. No date has been set for the trial, but due to COVID-19, jury trials have been taking longer to schedule.

There has been no indication in court regarding the relationship between the accused and the victim. Family members have previously told paNOW Hyman did not live in the trailer he was found in.
