Case of accused house thief back in court

The case of a man accused of stealing a dilapidated old house had been adjourned again.

However, his lawyer Mike Owens, told the court by phone he was having trouble nailing down exactly how many charges his client is facing.

“I’m having some difficulty…getting my head around everything that’s out there,” Owens told the court. “My problem is I’m getting disclosure from various sources.” He asked that the court go through each of the charges, just for clarity.

Matthew Malley, 32, was charged after a small house, which was mounted on a trailer, went missing from the Crooked River area.

RCMP said the house disappeared somewhere between midnight and noon on June 14. It was later recovered from the Nipawin area in July.

Malley, who is from Codette, south of Nipawin, was charged with theft under $5,000, and uttering threats.

Judge Lloyd Stang went through approximately a dozen charges on the docket against Malley. They include violating a curfew, failing to appear in court, and other charges not related to the house theft, such as being in possession of a truck obtained by crime.

“I understand he may have a transiency issue or something with his residence that’s causing some of these charges,” said Senior Crown Prosecutor Wade Rogers.

Owens replied Malley’s phone was out of commission for a while, and he was also having some trouble with where he was living at the time.

In the end, the court agreed to adjourn all of the charges to March 13.
