Trial postponed in Prince Albert sex assault case, warrant issued for material witness

Due to the absence of what was described as a material witness, the trial for a man accused of sexual assault, aggravated assault, uttering threats and forcible confinement has been delayed to November.

Dallas Fulton’s matters were discussed Tuesday morning at Prince Albert Provincial Court. Over half a dozen of his family members were in attendance in the gallery to view the proceedings.

The case itself dates back to last October. Police were called to a home along 8th Ave. and 15th St. W. One woman was treated for non-life-threatening injuries, stab wounds to her cheek and thigh, while one man was treated for a stab wound to his neck.

Crown Prosecutor Kristen Hubbard indicated plans to call on four witnesses to testify (three police officers and the female complainant). She explained that when the woman was subpoenaed last month, she had indicated an intention to come to court. Hubbard also explained the woman is transient in nature, but added police have been able to find her in the past.

Judge Harradence granted a one-hour adjournment to give police the opportunity to find her, but they were unable to.

When court resumed, Defence lawyer Chris Koban opposed the Crown’s request for a further adjournment of the trial, stating the chance to find her was based more on “hypothetical possibility” and not on a reasonable expectation.

Following a short five-minute adjournment, Judge Harradence ultimately agreed to adjourn the trial to Nov. 2. When explaining the reasons for his decision, Harradence cited the seriousness of the charges, as well as the fact the charges were still relatively new as there had only been 12 appearances on the matter.

The November date was the first date when both lawyers and the judge could be back for what’s expected to take a full day. As Fulton is in custody, a bail hearing is expected to take place prior.

In addition to the above-mentioned charges, he also has other matters before the court. He was one of five people charged after a vehicle stop and weapons seizure last January.

Knives, a loaded sawed-off shotgun, and a sawed-off firearm were among the items seized by police.

That matter is back in court on July 4.
