Charges stayed for drive-by shooting suspect

The man who allegedly pulled the trigger during a drive-by shooting in Prince Albert, striking an 18-year-old woman in the back, has no further scheduled court dates.

Kyle Bear, 29, was one of three people charged following the incident on Aug. 27, 2019. Last June, he entered not guilty pleas to various charges including attempted murder and the case was scheduled for trial. The Crown has since entered a stay of proceedings.

The man behind the wheel, Kirk McDonald, was sentenced last week and received a three-year prison sentence for his role. According to the statement of facts read in court, a gold-coloured Chrysler car pulled up alongside a second car in the 1400 block of Marquis Drive. A passenger in the suspect’s vehicle proceeded to fire three shots towards the other vehicle. One of the bullets struck the young woman, who was sitting in the back seat.

The suspect’s car then sped off northbound, while the second vehicle drove to the nearby skate park area. The victim was soon after rushed to hospital and pieces of the bullet were later removed following surgery.

According to several statements read in court during last week’s sentencing hearing, the attack was motivated by a rivalry between two street gangs. Citing the lack of witnesses to testify, Prosecutor Fatima Sarwar noted the Crown’s case had “issues.”

When asked Monday to explain the stay of proceedings for Bear, Sarwar declined to provide a reason, but said the Crown does have up to a year to re-commence proceedings.

A third person charged in relation to the case, Sherilyn Naytowhow, received a two-year jail sentence at a hearing on April 30, 2020.

Naytowhow was charged after police searched a residence on 28th St. E and found guns and drugs in the apartment.

Despite the stay of proceedings, Bear still has charges before the court. He was one of three people charged following an assault at the Prince Albert Correctional Centre.
