A court case surrounding the death of a Prince Albert city bus driver is moving forward.

Kenny Morin, 20, is facing a charge of second degree murder in the death last March of 61-year-old David Maxemiuk.

During a short hearing Friday morning at Prince Albert Provincial Court, Morin’s lawyer Michael Nolin elected for the case to be tried judge and jury, and a preliminary hearing was scheduled for Jan.18 to 22, 2021.

The purpose of the preliminary hearing is to weigh the strength of the crown’s evidence, and determine if there’s enough against Morin to warrant a trial.

Morin was originally charged with aggravated assault in connection to the incident on March 15, but with the victim’s passing in hospital five days later, the charge was amended. Morin was also charged with stealing Maxemiuk’s wallet.

David Maxemiuk drove the bus in the city for nearly 20 years. Family members have told paNOW he was attacked near his garage, shortly after returning from a trip to the grocery store. He leaves behind a wife and son.

No pleas have been entered in the case. Morin, who appeared via video from the Prince Albert correctional centre, where he is being held on remand, did not say a word during Friday’s hearing beyond confirming for the judge he was the accused.
