Minto apartment demolition appealed

A demolition order from the city against the downtown Minto Apartments has been appealed by the owner.

The city’s arm’s-length property maintenance appeal board upheld previous appeals and ordered the building demolished on Nov. 26, 2010.

The owner, Larry Markwart, was to appeal the order and on Jan. 25, one was officially filed in the Court of Queen’s Bench.

The original demolition order not only upheld previous decisions but also denied sale of the property to a third party.

“Little real effort was made by the owner or his agent to find a buyer or be creative in the effort to sell the property,” the board members wrote in their decision.

“Given the lack of effort exhibited by Mr. Markwart in his attempt to find a building manager or a potential buyer for the property, and giving his willingness to allow the matter to lie dormant before the Saskatchewan Court of Appeals, this board is unwilling to allow further extension of time with respect to this matter,” said the report.

The appeal alleges that the decision of the board was unreasonable, that its decision was based on information beyond the board’s scope, and that the denial of the sale was unreasonable.

The first hearing for the appeal will take place in March.
