High court rules against West Hill group

An affordable housing project proposed for Prince Albert's West Hill may have cleared its final legal hurdle.

The Saskatchewan Court of Appeal is upholding a lower court ruling that shut down a lawsuit against the City of Prince Albert.

The lawsuit was launched last November by the West Hill Historical Society to quash Bylaw #8 of 2009, which essentially paved the way for the affordable duplexes to be built on land near the Angus Mirasty School.

The group claims the city’s approval process was done unfairly and without proper notice and was asking the high court to reverse the decision handed down by Justice R.D. Maher.

The lawyer representing the group, Eric Lanoie thought it was unlikely they would continue, but said they would wait on the panels written reasons before deciding their next move.
