Prosecutor cites hole in indecent exposure case, stays charge

According to one Prince Albert Crown prosecutor, the only wrongdoing committed by a man last February at the Frank Dunn Swimming Pool, was the shorts he wore that day.

Tyrel Taylor said the charge against the 29-year-old man, accused of committing an indecent act in public, have been stayed on the grounds there was not sufficient evidence to prove the man intentionally tried to expose himself in public.

According to a news release from the Prince Albert Police Service, dated February 11, several police officers responded to the incident and dispersed throughout the facility when they arrived on scene. The man was arrested soon after and charged with what they had called “sexual-based” offences.

Taylor explained the man had a hole in his shorts, and made attempts to cover himself up when someone had brought attention to it. Police have said there was no physical contact with the complainant. Taylor added even the complainant, when interviewed, said they did not think the incident was intentional.

When a case has been stayed, the Crown has up to a year to bring it back to court, for example new evidence comes forward.
