Man who threatened store clerk with imitation gun, receives two year sentence

A man responsible for an armed robbery in Prince Albert, and who also pointed his imitation gun at a woman and her child, has received a two year jail sentence.

Brandon Ross, 23, has entered guilty pleas to robbery with an imitation handgun and assault with a weapon. The case dates back to October when Ross entered a convenience store in the city’s East Hill area and proceeded to threaten the clerk with an imitation handgun.

He would leave the store with lottery tickets, and went to the nearby Tamarack Apartment building. It was here he then crossed paths with a woman who was standing at the entrance with her kids. Ross pointed the weapon at the woman and said “what’s up” before continuing on his way.

According to the facts heard in court, Ross was extremely high at the time of the incident, to the point where he himself approached the officers when they arrived at the apartment building to speak to potential witnesses.

In addition to the jail sentence, Ross will also be on probation for a period of two years which will include a curfew, addictions treatment, and abstaining from drugs and alcohol.

A woman, who was observed holding the door for Ross at the store was also arrested, but her charges have all been stayed.

The court heard the store clerk was traumatized by the incident, had expressed fear to the Crown about testifying, and has since moved to a different province. In his remarks, Judge Jeff Lubyk noted the psychological impact from these types of crimes.

“People that work in these jobs, of course they are there to serve the public and are not looking to have people come in for anything more than some chips or chocolate bars,” he said.

The sentence represents a joint submission from the Crown and defence. When given the opportunity to speak in court Ross said he was sorry.

With 401 days credit for time spent in remand custody, Ross has roughly 11 months remaining to serve. Upon his release from custody, he will be prohibited from owning or possessing any weapons, explosives or fireworks for life.
