Bronco lawsuit against Sidhu, province fails

A lawsuit against the driver of the semi truck that collided with the Humboldt Broncos, the province of Saskatchewan and the bus company, has failed in Saskatchewan Court of King’s Bench.

Justice J. Mitchell dismissed the suit and said that provincial legislation that prevents the Herolds and four other families who lost a member in the 2018 crash from suing is not a violation of their Charter rights.

The Herolds were joined in their legal action by the families of Jaxon Josph, Logan Hunter, Jacob Leicht and Mark Cross.

The suit was filed not long after the fatal crash that saw 16 players and staff from the Bronco’s team die and 13 other people on the bus suffer varying levels of injury and permanent disability.

The semi truck driven by Sidhu was going to Melfort and then the next day to Balzac, Alberta.

He was hauling a load of peat moss that he had picked up in Carrot River when he struck the Bronco’s bus travelling north on Highway 35 to an SJHL playoff game in Nipawin.

Herold and his fellow plaintiffs wanted to change their original lawsuit to argue that Saskatchewan’s Automobile Accident Insurance Act, the Fatal Accidents Act and the Workers Compensation Act violated some of their rights by preventing them from pursuing claims of negligence and getting bereavement damages.

Mitchell found their application did not have a reasonable course of action and would be futile to proceed with.

He dismissed the suit and awarded costs to the defendants. Mitchell went so far as to say that allowing a portion of the suit to proceed would be vexatious, scandalous and an abuse of process.
