A man responsible for committing a sexual assault, and who was caught in the act by a patrolling police officer, has received a prison sentence of four years and two months.

With credit for time already spent in remand custody, Bert Montgrand has roughly three years left to serve.

The case that was discussed Wednesday morning at Prince Albert Provincial Court, dates back to April 22, 2024, when a member of the Prince Albert Police Service was doing a routine patrol in the city’s south hill area and came across two people having sexual intercourse on the grass.

A teenage girl, who was described by Crown Prosecutor Robyn Ermine as being very distraught, was crying when she ran towards the police car, pleading for help.

According to the facts read in court, the 17-year-old explained she met Montgrand earlier that day at the nearby mall, and while she did not know him, described him as being very kind and said they were hanging out.

At one point, he was pushing her around in a shopping cart.

While later walking in the area of the Best Western Hotel, Montgrand attacked the girl and forced her to have sex.

Montgrand said he was high on meth at the time of the assault and told police he thought the encounter was consensual.

At the time of the offence, Montgrand was on probation and his conditions included not being in Prince Albert. This stemmed from a prior sexual assault conviction for which he received a 30-month sentence.

When provided the opportunity to speak, Montgrand apologized for his actions and for the trauma he caused the young woman.

His lawyer Tim Nolan explained Montgrand himself had as a child been exposed to physical abuse and was sent to a foster home.

“He can recall waiting outside for his mom to come pick up,” Nolan said.

The case had originally been scheduled for trial, however it was noted by Ermine the guilty plea saved the victim and her mother from having to appear in court to testify.

In addition to the custodial sentence, Montgrand have a lifetime sex offender registration. He will be prohibited from owning guns for a 10-year period.
