Accused in brutal assault last winter acquitted

Dustin Durocher has been acquitted of the violent assault that left a Prince Albert man in a coma.

Complainant Lee Constant alleged that Durocher had viciously assaulted him with a weapon the night of Dec. 23, 2014, while they were both at a house party.

The acquittal was handed down Nov. 5.

Durocher’s lawyer Peter Abrametz thought the decision was very appropriate.

“There were starkly different versions between the complainant and the other witnesses that were there.”

During trial he argued that Durocher’s actions were self-defense and defense of property.  

Defense’s witnesses Andrew Simonot and Billy Brunet said during trial Constant had been more aggressive than originally stated.

“When it comes to Simonot he was sober, the only sober person there and he was impartial,” Abrametz said. “He didn’t have an axe to grind, and was neutral between both of them.”

Abrametz said Durocher was relieved. “He’s never been in trouble before, and he would have been facing a penitentiary sentence. He’s supporting a young family; of course (he’s) understandably very relieved.”

Neither Constant nor Durocher could not be reached for comments.
