Lawsuit being launched after Regina Beach house explosion

They were impacted by a natural gas explosion in Regina Beach last December and now they’re suing.

A group of property owners in the community northwest of Regina are listed in the lawsuit after the blast 10 months ago, caused after the soil shifted, ruptured a line releasing gas, which was then ignited.

The statement of claim was filed in Saskatoon, delivered on behalf of Robertson Stromberg. The law office explains the suit is actually being brought forth by The Co-operators, the insurance company acting on behalf of the individuals named in the document.

The suit is being brought against SaskEnergy and the Town of Regina Beach. It’s also being served to the registered owners of the property where the explosion is said to have occurred in the statement of claim, listed as Mark Julian Oldershaw, Lara Elizabeth Gaede, Jolyan Noel Oldershaw, Yank Bai, Mark William Oldershaw and Kathleen Beverly Diane Oldershaw.

It’s claimed the effects of the explosion caused significant physical, structural and/or foundational damage to the surrounding properties as listed in the suit.

The claim against SaskEnergy details how the explosion and resulting damage were caused by the negligence of the Crown corporation, explaining that SaskEnergy failed to design, construct and install a gas line capable of withstanding soil movement. Further, the statement alleges it was reasonably foreseeable to SaskEnergy that a line could rupture since it was placed in an area subject to soil movement.

It’s being claimed the town should have been aware of soil stability issues affecting the land.

As far as the registered owners of the property where the explosion is said to have happened, it’s being alleged they failed to put in any warning device capable of detecting an escape of natural gas. As well, they are also alleged to have failed at ensuring any appliances or devices would not serve as an ignition source for escaped natural gas.

The lawsuit is seeking the cost of repairs and reconstruction to the damaged properties, although no dollar figure has been specified.

A statement of claim contains allegations that have not been proven in court.
