Drug trafficker sentenced to 20 months less time served

A long running drug trial has finally come to a close.

A week ago, Judge H. Harradence heard closing arguments in the case of Jade Tyler Napope after finding him guilty of possessing cocaine for the purpose of trafficking.

Napope had also pleaded guilty to a number of other charges including possession of marijuana, as well as breaching recognizances and failing to appear for court.

Harradence sentenced Napope to 20 months in prison in relation to the cocaine charge with four sets of 15-day consecutive prison sentences for his other charges.

Napope had already served 264 days in custody and while the crown was asking for a 1:1 ratio of time served to be put towards his sentence, the judge decided to offer a ratio of 1.5:1 which would come out to 13 months served leaving Napope with nine months in prison.

His defence lawyer Mary McAuley said the case had caused her some aggravation at times.

“It’s not just because of the drug charges that were before the court, there were a lot of other factors, Mr. Napope had also been on the run for a while,” said McAuley. “It’s taken a while to get to this point, the trial was very contentious.”

She said that it’s a devastating case because so many drug traffickers become addicted themselves, and become trapped in a vicious cycle of selling drugs, both for profit but also to feed their own habit.

Speaking to the sentencing decision, McAuley, who was looking for 12 months, said it was fair.

“I would say it is fair,” said McAuley. “It’s cocaine, perhaps if it was a softer drug it would make a difference.”

She added that she was happy to see that the judge had sided with her on offering more time off of the sentence for time served, rather than the 1:1 ratio the crown had requested.

McAuley said this is a big win for offering a fair amount of time served in custody versus sentenced time, and is a decision which is both backed up by the Court of Appeal as well as the Supreme Court of Canada.
