Lawyer looking to move forward with Montreal Lake kidnapping case

A resolution may be in store for a man facing charges after an alleged Montreal Lake kidnapping and attempted murder of a family member.

Kevin Henderson was charged after the early July disappearance of Marina Henderson, 66, who family have confirmed to be Kevin’s aunt. Her vehicle was also stolen.

The 30 year-old-man was arrested on July 12, days after police began their search for him. Shantal Mike, 26, faces charges related to the kidnapping.

She received bail during the summer, and Henderson’s lawyer Brian Pfefferle said “I don’t think it would wrong to suggest that they’re considering Mr. Henderson as the primary perpetrator here.”

Henderson has not sought bail, but that’s because he is currently serving time on other charges.

“He’s obviously facing a very serious set of charges including an allegation of attempted murder out of his reserve area,” Pfefferle said.

The attempted murder charge involved stabbing – “certainly the injuries were very severe” – and the family relations in the case make it a really complicated issue, Pfefferle explained.

He’s been in talks with the Crown to decide how to deal with the charges.

“We would like to move the matter forward as soon as possible, whether it is by way of a resolution of some sort or whether it’s by way of a trial,” he said, adding that should happen in coming weeks.

Pfefferle said they’re also considering having Henderson go through a medical assessment to determine mental capacity and fitness.

“He’s facing a charge of attempted murder there’s a mental element that’s required for the Crown to prove and in certain cases a psychiatrist can give evidence with respect to an accused’s ability to form the intention to commit the act.”

Certain mental conditions have led judges or juries to find people not guilty in the past, he said, making the intention to commit a very important factor.

In relation to the July incident, Henderson faces charges of attempted murder, aggravated assault, kidnapping, two counts of stealing a motor vehicle, and three counts of failing to comply with a recognizance.
