Youths sentenced in trailer park home invasion case

Sentencing has been handed down to the two teenage boys who broke into an Eastview Trailer Court home on Mar. 31 and robbed a 92-year-old man.

The two boys, both around 16 years of age, will be spending time in jail. They can not be named under the Youth Criminal Justice Act.

They'll be spending ten months in closed custody followed by five months of community supervision, with time served factored in.

“We knew that they were going to get a custodial sentence. The only question was what type,” said Val Harvey, one of the defence lawyers.

“It was my opinion that an open-custody sentence was appropriate in these circumstances, but the judge thought otherwise.”

Judge Stan Loewen said in court, that he made his decision for closed custody because the offences were very serious, and that the youths are high risks to reoffend.

The teenagers also have a two-year firearm prohibition, but Loewen decided to not order a DNA sample.

“One DNA gets into the data banks, it goes beyond just what the Canadian system has, like the Canadian databank. It’s wide open. Interpol has access to it, the United States, other countries,” said Harvey.

“We don’t want our young people to be denied the opportunity to forget about their past and move past what happened to them as youths.”

Harvey said she has not decided yet if she will appeal the decision.

One youth was also charged with an assault, where he and five others assaulted a man who was taking out his garbage. The teenager asked him for a cigarette before striking him in the face.

The sentence he received for the assault will run concurrent to the sentence for the home invasion.
