Kim Walker Re-Trial Underway

A Crown attorney says Kim Walker fired 10 shots at his daughter’s boyfriend, James Hayward, killing him right in front of the 16-year-old girl.

Kim Walker is charged with second-degree murder in the 2003 death of 24-year-old Hayward in Yorkton.

He allegedly gunned down the Hayward — who Kim Walker has insisted was a drug dealer who was preying on his daughter.

Canadian Press reporter Jennifer Graham is covering Kim Walker's re-trial in Yorkton. She said four people took the witness stand on Tuesday. RCMP Sgt. Scott McMurchy, who was one of the first officers on the scene, was one of them.

Graham said that McMurchy told the jury he got a call of shots fired and responded. As he was approaching the home, he saw a man walking out. He told that man, later identified as Kim Walker, to put his hands up and get down on the ground.

Walker was then taken into custody.

McMurchy proceeded to enter the home where he saw Kim Walker's daughter, Jadah cradling a man who was, in McMurchy’s words, “obviously deceased.”

The body was that of James Hayward.

At the time of the shooting, Jadah Walker was 16. She was dating Hayward.

McMurchy also testified that gun powder residue was found on Kim Walker's hands.

A forensic specialist in Yorkton took the stand. He spoke about how bullets were found in the floors and the walls.

Graham said a gun instructor, who was an acquaintance of Kim Walker's and had instructed him for some time, also testified.

The jury noted evidence that Walker had a properly registered firearm

A neighbour of Hayward also testified. She who spoke about what she saw that day.

Graham said the jury is expected to hear from 8 more witnesses from the Crown, including Jadah Walker.

Graham said family members from both sides were present in court.

Walker was originally convicted in 2007 — but the decision was overturned on appeal.
