“Walmart baby” case in court of appeal

It is a step forward in the appeal of the “Walmart baby” case.

This morning April Halkett stood in front of an appeal judge. The Crown and defense took only an hour and a half to present their cases.

Halkett was acquitted last year of child abandonment. She gave birth in a Walmart bathroom in Prince Albert in 2007. She left her newborn son in the toilet, saying she thought he was dead.

The trial judge said he believed her and that she was scared at the time.

The Crown is appealing the acquittal on ground that the trial judge misinterpreted the law.

The appeal judge reserved decision on the case. It is not known when there will be a decision on the appeal.
