Election dispute proceeds to Federal Court

Nearly two years after the votes were tallied; the election results from a local First Nation are still being disputed.

A Federal Court will soon be asked to settle the controversy on the Sturgeon Lake First Nation.

“There is a real question here. The question being whether the appeal tribunal, that is the remaining two members and their legal advisor, acted in contempt on at least two court orders,” said lawyer Ron Cherkewich, who is representing Henry Felix.

In the March 2010 election, Felix narrowly lost to incumbent Wesley Daniels.

A tribunal dismissed the election appeal. But Cherkewich said the tribunal made a mistake.

“What we started off with was a process that was strictly under the election act. The rulers were all known. Then two-thirds across the stream, so to speak, they decided to switch horses and revert back and switch to the customs and practices of the First Nation that existed prior to the passing of the act,” said Cherkewich.

There is no timeline for when the case will be heard but Cherkewich said he will file an application in the next week or so.
